Head Quarters Quebec 5th April 1777
At the General Court Martial of which Lieut. Colo. MACKENZY was President, Phillip WITZEL, Frederick BARRINGTON, Christian SCMIDT, and Lodowick JACCA, private Soldiers in His Majesty's 21st or Royal North British Fusileers, tried for and found Guilty of desertion, are Sentenced to receive a thousand Lashes each.
Jacob FETZER, Peter KEBZIE, Frederick SATTO and Jacob STARTS, private Soldiers in His Majesty's 53rd Regt, tried for and found guilty of deserting with their Arms and Accoutrements, and making a resistance, by frequent firing at a party of the 20th Regiment which took them, the three first Jacob FETZER, Peter KEBZIE and Frederick SATTO, are Sentenced to suffer Death, and Jacob STARTS found Guilty of deserting, but acquitted of making resistance, is Sentenced to receive a thousand Lashes, and Anthony ARTWIN private Soldier in the same Regiment tried for and found Guilty of Desertion, is Sentenced to receive a thousand Lashes.
On a dispute between the 9th and 47th Regts. respecting Francis SINA Musician, Claimed by both the said Regts., the Court has determined that the said Francis SINA shall serve in the 47th Regiment.
Edward AGNEW, Corporal in His Majesty's Royal Regiment of New York tried for and found Guilty of desertion is Sentenced to be reduced to Serve in the ranks as Private, and to receive five hundred Lashes.
Cornet James GRANT of the 16th or Queens Royal Regiment of Dragoons, Acting as an Assistant to the Quarter Master General, and Mr. James CONNER Surgeon's Mate to the Genl. Hospital, tried for improper behaviour, in a public Coffee Room, Cornet GRANT is declared not Guilty of improper behaviour, as the Provocation he received was in the Opinion of the Court, Sufficient to Justify his behaviour to Mr. CONNOR, who is found guilty of improper behaviour, and is adjudged to be publickly reprimanded at the Head of the Garrison of Montreal.
The Commander in Chief approves of the proceedings of the aforesaid General Court Martial, and according to the Sentences thereof Orders, that the said Jacob FETZER, Peter KEBZIE and Frederick SATTO, private Soldiers in His Majesty's 53rd Regiment of foot, Condemned to suffer death, be Shot at the head of the said Regt. at such time as the Commanding Officer thereof shall appoint,
and that the said Jacob STARTS, and Anthony ARTWIN of the same Regiment, and Philip WITZEL, Frederick BARRINGTON, Christian SCHMIDT, and Ludowick JACCA, private Soldiers in His Majesty's 21st Regiment Sentenced to receive a thousand Lashes each,
and the said Edward AGNEW, Corporal in His Majesty's Royl. Regt. of New York, Sentenced to be reduced to Serve in the Ranks as private, and to receive five hundred lashes, receive the same Accordingly, at the head of the Regiments to which they respectively belongs, at such times as the Commanding Officers of such Regiments shall Judge proper.And Mr. James CONNOR adjudged to be reprimanded at the Head of the Garrison of Montreal is to be reprimanded Accordingly in the manner Major General PHILLIPS shall direct. His Excellency the Commander in Chief directs that his thanks be Signified at the head of the 20th Regiment to the Non Commissioned Officers and men of the Party which took the Deserters in Arms; and Commands that five Pounds for each Deserter be paid to the said Party as a reward for their Gallant and Soldier like behaviour, to be paid them by the 53rd Regiment, and charged in the Contingent Accounts.
